BREAKING: Appeal court in Enugu upholds ruling which struck out a suit challenging Governor Umahi defection


The Enugu State division of the Court of Appeal has upheld the ruling of a High Court sitting in Abakaliki which struck out a suit challenging the defection of Governor David Umahi of Ebonyi State from the Peoples Democratic Party – PDP, to the All Progressives Congress – APC in the State.

In his ruling Justice Joseph Oyewole held that the power to declare the holders of the offices of the governor and a deputy governor vacant was not conferred on the Judiciary by sections 180, 188 and 189 or any section of the constitution of the federal republic of Nigeria as amended.

He further noted that while the jurisdiction may be expanded, it cannot be expanded.
